Website Build Terms and Conditions

1. Introduction

These Terms and Conditions (“Terms”) govern the provision of website design and development services (“Services”) provided by Brand POP Pty Ltd (“Company,” “we,” “us,” or “our”) to the Client (“Client,” “you,” or “your”). By engaging our services, you agree to abide by these Terms.

2. Services

Provided The Company will provide website design, development, and related services as agreed upon in the project proposal, quote, or contract.

3. Payment Terms

• A non-refundable deposit of 60% is required before work begins.
• Payment installments must be made as specified in the agreed proposal.
• The final balance is due upon project completion and before the website is launched.
• Failure to pay may result in project delays or suspension.

4. Project Timeline

• We will provide estimated timelines, but delays may occur due to unforeseen circumstances.
• Client responsiveness is crucial to keeping the project on schedule.
• Revisions requested beyond the agreed scope may result in additional charges and extended timelines.

5. Client Responsibilities

• Provide timely feedback and required content, such as text, images, and branding materials.
• Ensure that all provided content is legally owned or properly licensed.
• Review and approve the website before final deployment.

6. Revisions and Modifications

• The project includes 3 rounds of revisions.
• Additional revisions beyond the agreed number may incur extra charges (R250p/h)

7. Ownership and Intellectual Property

• Upon full payment, the Client will own the final website.
• The Company retains the right to display the project in its portfolio.
• Any third-party software, plugins, or stock images remain subject to their respective licensing terms.

8. Hosting and Maintenance

• The Client is responsible for arranging website hosting unless otherwise agreed.
• Ongoing maintenance services are available at an additional cost.
• We are not liable for hosting-related issues unless included in our services.

9. Liability and Warranties

• We strive to deliver a high-quality product, but we do not guarantee uninterrupted or error-free operation.
• We are not liable for any direct, indirect, or consequential damages resulting from website use or downtime.

10. Termination and Cancellation

• Either party may terminate the agreement with written notice.
• If the Client cancels the project, payments made up to that point are non-refundable.
• If we terminate the agreement due to Client non-cooperation, no refunds will be issued.

11. Confidentiality

Both parties agree to keep all sensitive project information confidential.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Gauteng Division.

13. Amendments

We reserve the right to update these Terms at any time. Continued engagement of our services implies acceptance of any changes.
